The Biden administration’s recent memorandum on AI governance proposes a sweeping framework to regulate federal adoption of artificial intelligence. While the policy aims to promote trust, security, and equity in AI systems, it risks becoming yet another example of government overreach that could hamper the innovation essential for national security.
The memorandum embeds DEIA principles into AI governance, intending to prevent biases in applications used across sectors, including education and law enforcement. However, enforcing rigid equity standards in technology—especially within AI systems used for national security—can introduce new forms of bias, diverting focus from effectiveness to political compliance. A prime example of this concern arises with predictive algorithms used in surveillance or border security operations. If agencies are constrained by DEIA metrics, critical AI tools that detect emerging threats or anomalous behavior might be adjusted to avoid outcomes deemed socially “unbalanced,” even when such outcomes reflect genuine risks.
Moreover, the memorandum mandates “red teaming” protocols—structured efforts to identify vulnerabilities in AI models, often with external review teams. This approach echoes the NIST AI Risk Management Framework, which aims to make AI systems secure and trustworthy. Yet, requiring compliance with layers of oversight, reporting, and risk audits may slow the deployment of advanced AI capabilities essential to stay ahead of adversaries like China. For example, implementing AI tools for real-time cyber defense could be hindered by lengthy bureaucratic processes, leaving the nation exposed to attacks that move faster than regulatory approval cycles allow.
The framework also extends executive authority through the Defense Production Act, compelling private-sector developers to share sensitive test results with the government. Although intended to foster collaboration, such measures could deter innovation by discouraging companies from developing cutting-edge technologies for fear of excessive oversight. In the context of national security, this could limit our ability to field AI solutions in contested environments—whether predicting troop movements or mitigating disinformation campaigns—before adversaries gain the upper hand.
The policy also prioritizes international alignment, calling for cooperation on global AI standards. While this promotes a diplomatic veneer, it risks ceding strategic autonomy. Competitors like Russia and China will not hesitate to exploit AI advancements without regard for “equity” or privacy concerns. The U.S. must remain agile, unencumbered by regulations that prioritize social goals over national security outcomes.
This new AI governance model reflects a familiar tension: the desire to harness disruptive technology while ensuring it aligns with American values. However, effective AI governance should focus on empowering military, law enforcement, an intelligence agencies to act swiftly and decisively in high-stakes environments. If bureaucratic inertia stifles innovation, the result could be a U.S. security apparatus unprepared for tomorrow’s threats.
AI is a force multiplier in national security, but only if it’s allowed to function unimpeded. The administration’s push for safety and equity is well-intentioned, but the priority must remain on effectiveness. Failure to strike the right balance will leave the U.S. lagging behind competitors whose AI strategies are not held back by bureaucratic drag.
